There is an excellent article in the New York Times today about how the Feeney Amendment, limiting judges’ ability to depart from the sentencing guidelines, has come under widespread criticism from judges of all political stripes. Judge Sterling Johnson has found a creative solution:

Judge Johnson placed a blanket seal on all such documents in cases before him, forbidding Congress to examine these materials without his approval.

That sounds like a decent interim solution. In the meantime, I hope the amendment is repealed soon and such measures become unnecessary.
